These Terms of Use ("Terms") govern your access to and use of the Kepler service, website, and related applications (collectively, the "Service"). The Service is operated as Kepler by Saturn Mode, an independent software project operated by an individual developer ("we", "us", or "our"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Service.
1. Description of the Service
Kepler is an AI-powered scheduling assistant designed to help users optimize calendars, coordinate meetings, and generate productivity insights. Kepler is intended to function as a personal executive assistant for managing scheduling and time. The Service is an evolving software platform and may change frequently as new features are developed. We reserve the right to modify, suspend, or discontinue the Service or any portion of it at any time without prior notice.
2. Eligibility
The Service is intended for individuals who are 18 years of age or older. By using Kepler, you represent and warrant that you meet this requirement and that you have the legal authority to agree to these Terms.
3. Accounts
Certain features of the Service require the creation of an account.
You agree to provide accurate information when creating an account and to maintain the security of your credentials. You are responsible for all activities that occur under your account. If you become aware of unauthorized use of your account, you agree to notify us promptly. We may suspend or terminate accounts that violate these Terms or threaten the integrity of the Service.
4. Third-Party Integrations
Kepler may integrate with third-party services such as calendar providers and productivity tools. Your use of those services is governed by their respective terms and privacy policies. We do not control and are not responsible for the operation or reliability of third-party services. Changes to third-party platforms may affect the functionality of Kepler.
5. Google API Services
Certain features of the Service may access Google user data through Google APIs.
Kepler's use of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.
Google user data is used only to provide the functionality requested by the user, such as calendar scheduling and meeting coordination.
We do not use Google user data for advertising purposes and do not sell Google user data.
6. Paid Features and Pricing
Some features of the Service may require payment or subscription access.
You acknowledge that:
- pricing may change at any time
- features may move between free and paid tiers
- subscription offerings may be modified or discontinued
Unless otherwise stated, subscription fees may renew automatically until cancelled.
Because Kepler is an evolving product, we make no guarantees regarding the continued availability of any particular feature.
7. Acceptable Use
You agree to use the Service only for lawful purposes and in compliance with these Terms.
You may not:
- attempt to access systems or data without authorization
- interfere with the security or operation of the Service
- reverse engineer the software
- use the Service for unlawful, abusive, or fraudulent activity
We may investigate and take appropriate action, including suspension or termination of accounts.
8. Intellectual Property
The Service and all associated content, software, and branding are the property of Kepler by Saturn Mode or its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose. You may not copy, distribute, modify, or create derivative works based on the Service without permission.
9. Scheduling Disclaimer
Kepler may generate scheduling suggestions, meeting summaries, and productivity insights. These outputs are generated automatically and may be incomplete or inaccurate. Users remain responsible for verifying calendar events, meeting times, and scheduling details. Kepler is not responsible for missed meetings, scheduling conflicts, or any consequences resulting from reliance on automated recommendations.
10. Artificial Intelligence Processing
The Service may use artificial intelligence systems to analyze scheduling data and generate insights. User data may be processed to provide these features. However, user data is not used to train external AI models.
AI-generated outputs should be considered informational and may not always be accurate or complete. The Service may generate automated recommendations, summaries, scheduling suggestions, and other outputs based on available information. These outputs are generated by software systems and artificial intelligence models and may be incomplete, inaccurate, or outdated. Users should not rely solely on automated outputs when making professional, business, scheduling, or personal decisions. Kepler is intended to assist users with productivity and organization but does not replace independent judgment or verification.
You acknowledge that you are solely responsible for reviewing and confirming the accuracy of any information generated by the Service before relying on it.
11. Service Communications
By creating an account or using the Service, you consent to receive service-related communications from Kepler.
These communications may include:
- account notifications
- security alerts
- scheduling notifications
- invitations sent through the platform
- billing and subscription notices
- product updates
Users may opt out of optional communications where available, but essential service communications may still be sent for operational purposes.
12. Disclaimer of Warranties
The Service is provided on an "as-is" and "as-available" basis.
We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee uninterrupted or error-free operation.
13. Limitation of Liability
To the maximum extent permitted by law, Kepler by Saturn Mode shall not be liable for indirect, incidental, special, consequential, or punitive damages.
This includes damages related to lost profits, lost data, business interruption, missed meetings, or scheduling errors.
If liability is established, the total liability shall not exceed the amount paid by the user for the Service during the twelve months preceding the claim.
14. Termination
We may suspend or terminate your access to the Service if you violate these Terms or if continued access may harm the platform or its users.
You may discontinue use of the Service at any time.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes to the Service or legal requirements.
Updated versions will be posted on the website and will take effect upon publication.
16. Governing Law
These Terms are governed by the laws of the State of California.
Any disputes arising from the Service shall be resolved exclusively in the courts located in California.
